By accessing this website and/or making a purchase, the user agrees to be bound by the terms and conditions stated below. Elena OnTheRoad offers a variety of tours, tickets, and services through this website (elenaontheroad.com) and through designated partner websites. Since our Terms and Conditions contain legal obligations, we recommend that you read them carefully. Unless otherwise stated, purchases made through elenaontheroad.com or any other website affiliated with Elena OnTheRoad are subject to these Terms and Conditions; in all booking agreements, the person making the reservation will be considered as having accepted these conditions on behalf of the individuals listed in the reservation.

1.1 All use of the site www.elenaontheroad.com is subject to the following terms and conditions. If you do not agree with these conditions, cease the use of the Site immediately.
1.2 The user may print and save a copy of these terms. These are a legal agreement between us and can only be modified with our consent. We reserve the right to change the terms at our discretion by changing them on the Site.

1.8 Your use of elenaontheroad.com or any websites affiliated with elenaontheroad.com is for personal, non-commercial use and/or to make legitimate orders to book the products or services offered. The user agrees not to use this site to make any speculative, false, or fraudulent orders. The customer agrees not to use robots or other automated means to access this site unless specifically allowed by Elena OnTheRoad.

Material provided by the Visitor

2.1 In these terms of use, the visitor provided that "material" includes, without limitation, text, images, audio material, video material, and audiovisual material submitted to our website, for any purpose.
2.2 Any material that a visitor to the Site submits or places on elenaontheroad.com will be considered non-proprietary and non-confidential. We have the right to copy, disclose, distribute, or use for any other purpose that we deem appropriate all material provided to us, except for personal information, the use of which is covered by our Privacy Policy.
2.3 By using elenaontheroad.com, the user must not post or send to or from the Site any material:
- for which they have not obtained all necessary consents;
- that is discriminatory, obscene, pornographic, defamatory, likely to incite racial hatred, in violation of confidentiality or privacy, that may cause annoyance or inconvenience to third parties, that encourages or constitutes conduct that would be considered a criminal offense, that gives rise to civil liability, or that is otherwise contrary to the law in Portugal;

- that is harmful in nature, including, without limitation, computer viruses, Trojan horses, corrupted data, or other potentially harmful software or data.
2.4 We will fully cooperate with any law enforcement authorities or court orders that require us to disclose the identity or other details of any person who posts material that is in violation of this website.

Prices - Inclusions and Exclusions

3.1 The prices displayed on the Elena OnTheRoad website are per person unless otherwise indicated.
3.2 Prices are subject to change until the booking is confirmed.
3.3 What is included is specifically stated on each tour page.
3.4 Children under eighteen must be accompanied by an adult.
3.5 Unless otherwise stated, prices include all local taxes, charges, or fees.
3.6 Prices do not include (unless otherwise stated) - tips to the guide, driver, or tour guide, extra food and drinks.

Payments

4.1 The Company accepts the following Credit Cards: Visa, MasterCard, American Express, and Discover.
4.2 The Company accepts payments made through PayPal and Xoom.
4.3 There is no fee or service charge for the customer for credit card payment processing.
4.4 Full payment is required at the time of booking. The Company does not accept partial payments.

Refunds and Compensation

5.1 All cancellations must be communicated by email to ontheroad.with.elena@gmail.com.
5.2 Reservations canceled at least 7 days before the scheduled tour start time can be rescheduled for free, or we will be happy to offer a refund. If you choose to proceed with the refund, a processing fee will be charged.
5.3 Reservations canceled less than 7 days before the scheduled trip are non-refundable.

Electronic Tickets

6.1 All offers presented on the Site can be booked online or by email.
6.2 Customers who have purchased tickets will receive an electronic ticket by email.
6.3 Customers must keep electronic tickets to have tour information readily available.

Special Requirements

7.1 At the time of booking, we need to know if there are any special needs or requirements. It is particularly important that we are informed of any food allergies, dietary restrictions, or mobility issues.

Tour Information

8.1 We may, at our discretion, require anyone to withdraw from any tour if we consider their acts or conduct offensive or a nuisance to other customers.
8.2 We reserve the right to cancel any tours due to the unforeseen closure of partners or other adverse conditions. We also reserve the right to change prices, locations visited, or itineraries at any time due to unforeseen circumstances. All efforts will be made to notify customers in advance of any changes deemed necessary.
8.3 In the event that a tour is not conducted for any reason, no liability will be accepted by the company beyond the refund of the

 fees.
8.4 If the customer does not arrive or arrives late at the meeting point or during the tour, the tour will not be delayed to wait for the customer.

Accident or Loss

10.1 We have no responsibility for losses, damages, delays, inconvenience, or direct or consequential losses, whatever the cause, except due to negligence of our employees, in which case our liability is limited (except for death or personal injury) to a maximum of the refund of the tour cost.
